Deckhand claims back injuries in Jones Act suit

A deckhand injured on the M/V KW, filed a Jones Act suit against Charleston, Mo.-based Fitzgerald Marine and Repair in U.S. District Court June 4, seeking damages in excess of $75,000.

Mike Jenkins, also of Charleston, claims he injured his back while throwing a pump onto a distressed boat on July 2, 2006.

Jenkins claims Fitzgerald was negligent in that it failed to provide him with a reasonably safe place to work, and reasonably suitable equipment to perform his assigned duties.

He claims his back injuries caused a permanent disfigurement, pain and suffering, lost wages and medical expenses.

Jenkins is represented by Gerard B. Schneller of Holland, Groves, Schneller & Stolze in St. Louis.

The case has been assigned District Judge David Herndon.
