Abortion clinic and doctor sued by Granite City woman

4/29/2008 6:31 AM

Hope Clinic
Brandy Hildreth of Granite City is suing the Hope Clinic for Women in Granite City claiming it committed battery by allowing a different doctor than the one she specified perform an abortion Feb. 8.

Hildreth, 26, claims Chicago-area doctor Lisa Memmel, M.D. performed an abortion, even though Hildreth consented to be treated by a "Dr. Palmer," states the complaint filed April 23 in Madison County Circuit Court.

Memmel has been named as a respondent in discovery.

According to a press release issued by staunch anti-abortion activists Angela and Daniel Michael who operate Small Victories mission, Memmel "should never have done the abortion because of (Hildreth's) other pre-existing medical conditions."

Hildreth's attorney, Rhonda Fiss of Belleville, asks for leave to name Memmel as a defendant within six months of the filing.

"That the performance of the abortion upon Plaintiff by Respondent in Discovery was totally without consent; or, alternatively, was against the Plaintiff's will; or, alternatively substantially varied from the specific consent granted by Plaintiff," the complaint states.

"That as a result of the said battery, the Plaintiff sustained damages in the form of physical injuries, emotional harm, medical expenses, including past and future medical expenses, disability, disfigurement, and the loss of normal life."

Hildreth is seeking in excess of $50,000 from Memmel and from Hope Clinic, plus costs of the suit.

"Abortions aren't any safer than they were 30 years ago, they just cost more," the Michaels state in a press release.
