Woman sues trucking company over injuries

7/24/2008 12:51 PM

A woman who was injured while unloading a tractor trailer filed a personal injury lawsuit against USA Truck and driver Michael Perlick, alleging they were negligent.

Sandra Myers claims she was working as the supervisor at Professional Contract Services (PCS) on Aug. 9, 2006, when a USA Truck operated by Perlick arrived to be unloaded.

PCS is a warehouse in Granite City.

According to the complaint filed in Madison County Circuit Court on July 22, Perlick backed into the loading dock that contained a large metal dock plate, which creates a bridge between the loading dock and the trailer that allows the trailer to be unloaded on a flat stable surface.

Myers claims she was inspecting paperwork regarding the delivery when, without warning, Perlick pulled the tractor trailer away from the dock causing the metal dock plate she was standing on to collapse.

Myers claims Perlick negligently failed to warn her that he was going to move the truck, failed to lower the bridge before moving the truck, failed to keep a careful lookout and failed to pull the dock plate out before pulling the truck away from the docket.

She claims the fall caused her to sustain injuries to her head, right shoulder, right wrist, left wrist and hips. She said her injuries caused and continue to cause pain and suffering, medical expense and lost wages.

Represented by Matthew Padberg and Geoffrey Jones of St. Louis, Myers is seeking damages in excess of $100,000, plus costs.

The case has been assigned to Circuit Judge Daniel Stack.
