Cahokia school district, village sued for crack in sidewalk

7/24/2008 1:54 PM

Tina Isaac of Fairmont City is suing the Village of Cahokia and Cahokia Unit School District 187 for injuries she sustained last year after tripping on a crack in the sidewalk near the entrance of the school.

She claims the school had constructive notice of the dangerous condition that existed where she fell on Nov. 14, 2007.

According to a suit filed July 21 in St. Clair County Circuit Court, Isaac injured her hands, wrists, arms, fingers, elbows and body as a whole.

She claims the village, in charge of maintaining the sidewalk, failed to properly inspect and repair the sidewalk in front of the school located at 800 Range Ln.

Her husband, Kerry Isaac, is a co-plaintiff seeking damages for loss of consortium.

"Plaintiff Kerry Isaac has suffered the loss of the services of his wife Tina Isaac which prior to her injuries were of great value to him and he has been deprived of her affection, society, companionship and consortium," the complaint states.

The Isaacs are represented by Steven E. Katzman of Katzman & Associates in Belleville. They are seeking in excess of $200,000 in damages plus costs of the lawsuit.
