AMEX sues Swansea man

8/25/2008 4:15 PM

American Express (AMEX) has filed a breach of contract complaint against a Swansea resident, alleging he failed to pay the balance owed on his credit card.

Represented by Michael Starzec of Wheeling, AMEX claims Michael Young agreed to pay all amounts charged to his credit card but has failed and refused to make payments set forth in his statements.

"The total outstanding, overdue and unpaid balance owed by Defendant to Plaintiff on the Account is $91,674.71," the complaint filed Aug. 20 in St. Clair County states.

AMEX also alleges Young has been unjustly enriched because he has benefited from the items he charged on his credit card.

In addition to the balance due, AMEX is also seeking attorneys' fees, court costs, collection costs and pre-judgment interest.
